Checkpoints

DWI checkpoints—also known as roadblocks sobriety checkpoints—have become commonplace throughout New Jersey. Police set up these roadblocks all over the state on weekends and holidays to stop innocent people and treat them like criminals. Although the Supreme Court has ruled that DWI checkpoints are legal under certain criteria, there is a growing concern among the legal community about their validity.

DWI Checkpoint Effectiveness

Police often publish the statistics gathered from these DWI checkpoints. In the vast majority of these reports, less than 1% of the vehicles stopped were actually cited for DWI. That means that hundreds of drivers were unnecessarily put into high-pressure situations.

When conducting a DWI checkpoint, police officers are under pressure to make drunk driving arrests. When an officer is locked into this mindset, it is easy to misconstrue a common, everyday symptom such as red eyes—which could be caused by allergies or a lack of sleep—as a sign of impairment. This leads to a high number of false DWI arrests.
