Ignition Interlock Device New Jersey
An ignition interlock device is an in-car Breathalyzer that gets attached to your ignition. In order to start your car, you must provide a proficient breath sample and if you are over a designated number, in most cases a .05 or greater, your car won’t start. Furthermore, during various points of your driving, the ignition interlock device will request that you blow into it. If you fail to blow into it, the car will cease to operate. You will be ordered to install an ignition interlock device in your car for any refusal conviction and for any first offense DWI of a .15 or greater and all second and third offenses. If ordered to install one, you must keep it in your car for the period of the suspension plus a period of time afterwards.
For first offenders, that’s six to eighteen months after you get your license back and for all second and third offenders its for one to three years after you get your license back. The ignition lock is not free either, you must pay to have it installed, un-installed, and a monthly payment for it. If you’re ordered to install an ignition interlock device in a car, then you will not get your license back unless you install one, even if you don’t own a car. Failure to do so will prevent you from getting your license back.
At the Hernandez Law Firm we have saved many drivers from the mandatory order of an ignition interlock device by either beating their reading or beating their case outright. If you have been charged with DWI or refusal anywhere in the state of New Jersey it is extremely important that you give us a call to discuss your case and any defenses that may be available to you.
