New Jersey Federal DUI / DWI Defense
From national parks to military installations, there are many areas in New Jersey that are considered federal lands. A DWI violation on this land will result in a federal DWI charge.
Penalties for a Federal DUI
There are two types of federal DWI offenses: those committed on lands managed by the National Park Service and those committed on other lands, such as military bases.
For DWI cases on lands administered by the National Park Service, you can face up to six months in a federal jail as well as up to $5,000 in fines.
For federal lands not under the National Park Service, the prevailing state law is applied. In some cases, if the offense is committed on a military base, additional penalties may apply.
Federal DWI Convictions
Federal DWI cases are handled as bench trials in federal courts. A conviction will be recorded on your federal criminal history. There is no possibility for expungement unless the President of the United States pardons you.
